1. Service overview
The Horse Performances website presents a remote equine performance data analysis service (hereinafter referred to as "the Service") and invites users to subscribe to it. The equine performance data (hereinafter referred to as "the Data") refers to physical and physiological information collected by any sensor available on the market and validated for equine species. The analysis of this Data gives rise to the drafting of reports, which are sent by email to the person who subscribed to the Service (hereinafter referred to as "the User").
2. Service description
The Service allows the User to remotely submit the Data from equine sensors, in order to obtain a detailed analysis. The Service includes:

An analysis of each training session recorded and transmitted by the User, referred to as “Session Analysis”. A summary report, highlighting the most significant elements, is sent to the User as soon as possible after the Data is received.

A long-term analysis, designated as "Training Analysis", based on a longitudinal study of the submitted Data, for a single horse or a group of horses. It gives rise to the communication of detailed reports, the nature and frequency of which depend on the observations made.
The content of these reports is tailored to the User, their organization and their infrastructure. However, it is fully customizable according to the User's preferences, which must be communicated in advance.
It is important to note that, due to the amount of Data required for the Training Analyses, these will only be performed for horses that have been subscribed to the Service for more than two months.
3. Subscription to the Service
Subscription to the Service is personal and applies for each horse whose Data is to be analyzed. It is carried out according to the following terms:

Registration: anyone wishing to subscribe to the Service must register using one of the methods available on the Horse Performances website (registration form or direct contact). An email will then be sent to collect the necessary information to set up the Service, and must be returned duly completed for the registration to be validated.

Amount: the subscription to the Service begins upon receipt of a payment of sixty-nine euros excluding tax per horse, subject to a 20% VAT rate, amounting to a total of eighty-two euros and eighty cents.

Payment terms: payment is made exclusively by bank transfer, the account details being provided once the User's registration is validated. An invoice will be issued monthly by Horse Performances and sent to the User by email.

Subscription to the Service constitutes full and complete acceptance of these Terms and Conditions by the User.
4. Subscription duration
The subscription to the Service is valid for one month, precisely until the same day of the following month as the receipt of payment. It can be extended by renewing the subscription procedure described in paragraph 3 (registration excluded) before this date.
There is no commitment beyond this one-month period: the User is free to not renew their subscription without notice, which will immediately interrupt the Service for the concerned horse.
No refund of the amounts paid is provided.
5. User Responsibilities
The User is responsible for:

The acquisition, installation and use of sensors required for the implementation of the Service;

The transmission of the Data necessary for the execution of the Service. It must be carried out exclusively by the means chosen by Horse Performances and indicated at the time of subscription;

The truthfulness and completeness of the Data sent;

The use of the analyses and reports provided by the Service, in compliance with applicable laws and regulations.
The User undertakes not to transmit incorrect or illegal Data and to inform Horse Performances in case of any issues related to the submitted Data.
6. Service Responsibilities
As data analysis is a recent and rapidly evolving discipline, it should be noted that the reports and analyses provided by the Service solely result from the interpretation of the Data transmitted, by Horse Performances' analysts, on the basis of their own experience, the information provided by the User and current scientific data.
Horse Performances cannot be held responsible for the consequences of improper use of the analysis results or Data, particularly in the event of misinterpretation of the reports and analyses provided. The User remains solely responsible for the decisions he makes based on the results provided by the Service.
Finally, as the transmission of the Data is solely the User's responsibility, in accordance with paragraph 5 of this document, Horse Performances cannot be held responsible for any lack of consistency, reliability or accuracy of the reports and analyses provided, due to a low number of data available.
7. Ownership of the Data
The performance data transmitted by the User remain their property but they grant Horse Performances a non-exclusive, transferable, free and worldwide license for their use, as part of the Service or for scientific research. In the latter case, the User agrees that this Data may be used indefinitely, even if their subscription is not renewed.
In all cases, Horse Performances undertakes to respect strict confidentiality in the processing of this Data, by communicating only with the User or third parties designated by them within the framework of the execution of the Service and by making completely anonymous the Data used for scientific research.
8. Confidentiality and protection of personal data
Personal data is processed in accordance with the applicable regulations, developed in our Privacy Policy .
9. Force majeure
Horse Performances will not be liable for delays or failures in service caused by a force majeure event, as defined by French case law.
10. Amendments to the Terms and Conditions
Horse Performances reserves the right to modify these Terms and Conditions at any time. Any modification will be published on the website and will come into force as soon as they are posted online. The User will be notified of any significant change by email.
11. Applicable law and dispute resolution
These Terms and Conditions are governed by French law. Any dispute relating to their interpretation or execution will be subject to the exclusive jurisdiction of French courts.
